Terms and Conditions

1. Acceptance

By accessing, browsing or registering to play at South Beach Casino & Resort ("the Property"), you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions (the "Agreement"). If you do not agree with any of the terms of this Agreement, please do not use our services.

2. Definitions

In this Agreement:

• "You" or "User" means an individual accessing the Property for gaming purposes.
• "We", "Us", "Our" refers to South Beach Casino & Resort and its affiliates.
• "Gaming Services" include any game offered on-site, promotional offers, loyalty program benefits, etc.

3. Eligibility

To use our Gaming Services, you must be at least 18 years of age (19 in some provinces), possess a valid government issued photo identification, and meet the requirements under Manitoba's Gaming Control Act and its associated regulations.

4. Responsibility

You are fully responsible for your gaming activities on-site at South Beach Casino & Resort and acknowledge that Our responsibility is limited to providing reasonable facilities for gaming.

5. Gaming Rules

The Property is subject to the applicable laws of Manitoba, including but not limited to The Gaming Control Act and its associated regulations. We reserve the right to modify our rules at any time by updating this Agreement or posting changes in designated areas within the Property.

6. Personal Data Protection

We respect your rights regarding personal data protection as outlined in Manitoba's Freedom of Information and Privacy Protection Act, 2015 (the "Act"). To view information on how we collect, use, disclose and protect your information, please visit our website or contact one of Our designated staff members.

7. Compliance with Laws

We comply with the laws and regulations applicable to gaming in Manitoba. You are responsible for ensuring that you understand these laws before accessing any of Our Gaming Services. If We suspect any irregularities, including but not limited to betting syndicates and/or underage gambling or money laundering, your access will be suspended immediately.

8. Responsible Gaming

We promote responsible gaming practices as outlined by the Manitoba Liquor & Lotteries Corporation. This includes offering information on problem gaming services, limiting stakes per player where possible and preventing direct cash transactions at tables games when required. If you suspect someone may have a problem with gambling please inform one of our staff immediately.

9. Cancellation

We reserve the right to cancel any Gaming Services or remove your access to them if:

• You breach this Agreement;
• There is suspicion that Our rules are being used for gaming purposes other than as intended; and/or
• We otherwise deem it reasonable to do so.

10. Indemnity

You agree to indemnify, defend and hold harmless South Beach Casino & Resort from any losses or damages arising in connection with:

• Your breach of this Agreement;
• Any claims by third parties resulting directly or indirectly from your gaming activities at the Property;
• Failure to meet Manitoba's Gaming Control Act requirements.

11. Liability Limitation

In no event will Our liability exceed the amount that we are required to pay under the applicable laws and regulations governing our operation of a licensed gaming facility in Manitoba. You agree not to hold Us liable for any indirect, special or consequential damages arising from your use of Our Gaming Services.

12. Governing Law

The laws of Manitoba govern this Agreement and its interpretation, regardless where you are physically located at the time of using Our services. Any disputes will be resolved through the courts of Manitoba in accordance with their jurisdiction.

13. Entirety

This Agreement constitutes the entire agreement between Us and supersedes all prior or contemporaneous agreements, whether written or oral.

By continuing to use our Gaming Services, you signify your acceptance and understanding that these Terms and Conditions are applicable to each instance of accessing Our services on-site at South Beach Casino & Resort.
